GENERAL TERMS OF SALE (GTS)

Axiomtext.com is an online service provided by AxiomText, whose registered office is located in Dakar - Ouakam cité El Hadj Oumar Foutiyou Tall. These general terms establish the terms of sale exclusively online of axiomtext.com products and are concluded between AxiomText and the customer, also referred to as the User.

The invalidity of a contractual clause does not affect the validity of the general terms of sale as a whole. By accepting these general terms without reservation, the customer is deemed to have fully accepted them.

These general terms of sale comply with Senegalese legislation and apply in Senegalese territory. Regardless of the territory where the service is used, the customer acknowledges complying with these general terms of sale and understands that the service is provided in Senegal.

The prices for sending messages, SMS, and services offered are those indicated on the order form.

AxiomText reserves the right to modify its prices at any time and without notice.

However, the price of prepaid services is guaranteed for the relevant period.

Payment is due immediately upon order. The customer can make payment by credit card or any other payment method indicated on the site.

Payments made by the customer will only be considered final after effective collection of the amounts due by AxiomText.

In case of default or delay in payment by the customer, this will automatically result in the termination of the current contract.

Once the customer has placed their order online and their payment has been validated, they will receive an identifier at the email address indicated in their order form.

This identifier will allow them to manage the AxiomText products they have ordered, particularly by giving them access to their customer area.

AxiomText undertakes to do its best to record and send SMS messages once payment for the corresponding order has been validated. However, this is an obligation of means and in no way an obligation of result.

AxiomText offers the customer free hosting of their customer databases and number lists on its servers.

AxiomText undertakes never to disclose or use customer databases hosted on its servers.

The customer has complete freedom regarding SMS content, which is limited to 160 characters for the SMS offer.

The customer has the possibility to terminate their subscription before its term by notifying AxiomText in writing (registered letter).

This termination does not entitle to any refund.

If information is incomplete, incorrect, or if documents are missing, or if the request does not comply with the naming charter, AxiomText will suspend the request and no refund or credit will be issued.

The customer undertakes to provide accurate and truthful information during registration. They must inform AxiomText of any changes regarding the provided data.

The customer assumes exclusive responsibility for any violation of third-party intellectual or industrial property, public order, good morals, as well as any other dispute concerning the SMS messages sent.

The choice of SMS content is exclusively the customer's responsibility. Under no circumstances can AxiomText be held responsible for claims related to the content broadcast by SMS messages.

All elements of the axiomtext.com site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks, or patents.

These elements are the exclusive property of AxiomText. Any reproduction or representation, in whole or in part, of the site or any of its components, without the express authorization of AxiomText, is prohibited.

The customer undertakes not to access AxiomText's computer systems or attempt to do so.

AxiomText undertakes to respect the confidentiality of personal data communicated by the customer.

The personal data collected are necessary for order processing and invoice establishment.

In accordance with Law No. 2008-12 of January 25, 2008 on the protection of personal data, the customer has the right to access, rectify, and object to personal data concerning them.

These general terms of sale are subject to Senegalese law.

In case of dispute, an amicable solution will be sought before any legal action.

In the absence of an amicable solution, Senegalese courts will have exclusive jurisdiction.
